Let me start by stating that I do not advocate breaking any traffic laws. Running a red light can seriously hurt others or yourself. People make mistakes -- no one is immune from that fact, however with a fine up to $408 and the assumption that you are automatically guilty, it's just another blatant opportunity for county and local governments to gouge California drivers.

If you recently received a Red Light Camera citation within the State of California, then you've come to the right place. You are being charged with violating section 21453 of the California Vehicle Code. This is a moving violation which carries a penalty on your DMV driving record for 3 years and will likely result in years of higher insurance premiums, not to mention the huge fine.

California Red Light Camera Ticket Law

California VC 21453.   (a) A driver facing a steady circular red signal alone shall stop at a marked limit line, but if none, before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown, except as provided in subdivision (b).

The vehicle code above is the star of the prosecution's case but there are a series of other laws, not only at the state but also at the federal level which are important to your situation. Understanding ALL your rights and knowing how the system works can significantly improve your chances of having your red light camera ticket case dismissed.

Remember, the American justice system is predicated on the belief that you are innocent until proven guilty. But if you're not convinced, consider these reasons:

• What's next... Photo radar on the freeways? Sad to say, only 1% of drivers who receive a Red Light Camera citation actually contest their violation notice. It won't take long for the greedy politicians in Sacramento to consider other forms of automated enforcement if drivers simply pay up without a fight.
Local officials want you to think a Red Light Camera is only for vehicle safety but in reality, Automated Enforcement is merely an Automated Revenue Generator.

While local governments are quick to cite red light running statistics, most are also eager to downplay the HUGE profits generated from automated violations in some California cities. In fact, the greed became so apparent, an amended Red Light Camera law went into effect January 1, 2004. It was inspired by a case in San Diego, where the (former) Lockheed-Martin company was operating under a ticket-based revenue agreement. It was ruled "untrustworthy and unreliable," by Superior Court Judge Ronald Styn.

West Hollywood, CA - "West Hollywood collected an estimated $4.9 million during the first 12 months of operation." Los Angeles Times

Known as the Red Light Reform Bill, AB 1022 prevents Red Light Camera vendors from being paid based on the number of citations they issue. However... local governments who approved their use prior to the January 1, 2004 deadline were grandfathered, thus exempt from the requirement. Not surprising, cities such as Oceanside, Vista, Del Mar and Encinitas quickly approved the use of Red Light Cameras so they could operate under the old version of the law.
